Terms of Use

The short version: you're joining an art journaling community. Pay your membership, be kind to the other humans, don't republish our classes elsewhere, and you keep owning your own artwork. The full detail is below. There's also a plain-English summary of the important bits if that's more your speed.
1. Who we are
Get Messy is run by Caylee Grey and Vanessa Oliver-Lloyd, through two companies.
Your membership contract is with:

More Than Zero, LLC takes your payment, gives you access to the Service, and is the company you're contracting with.

Get Messy (Pty) Ltd handles South African operations. It doesn't take payments from members.
In these terms, "Get Messy", "we", "us" and "our" mean More Than Zero, LLC and, where relevant, Get Messy (Pty) Ltd. "You" and "your" mean you, the human reading this.
"The Website" means getmessyart.com and all of its subdomains, including archive.getmessyart.com, together with any community platform, app or member area we operate.
"The Service" means membership of the Get Messy art journal community, including the class library, the community platform, hangouts, forums and any other members-only content.
2. Agreeing to these terms
Using the Website means you accept these terms. If you don't accept them, please don't use the Website.
We can change these terms. When we do, we'll email everyone with an active membership at least 30 days before the change takes effect, and we'll update the date at the top of this page. Changes that affect what you pay only apply from your next billing cycle. If you don't like a change, you can cancel before it takes effect and you won't be charged again.
We won't make changes retroactive. What you agreed to when you joined governs anything that already happened.
3. Your account
To use the Service you'll create an account with a username and password.
Keep your password to yourself. You're responsible for what happens under your account.
Don't pick a username that belongs to someone else, infringes a trademark, or is offensive, vulgar or obscene.
Tell us straight away at yay@getmessyart.com if you think your password has been compromised.
Keep your details accurate and current, especially your email address and payment details.
We're not liable for losses caused by someone else using your account, unless that happened because of something we did wrong.
You need to be 18 or older to hold a Get Messy account. If you're under 18, please don't sign up.
We can refuse a registration, disable an account, or edit or remove content, where there's a good reason to. We'll tell you why, and if we close your account for a reason that isn't your breach of these terms, we'll refund the unused portion of your membership.
4. Membership and payment
You can buy a monthly or yearly membership. With it you get access to Get Messy content, forums and private groups for as long as your membership is active.
Monthly memberships bill on the same day each month, matching the day you signed up.
Yearly memberships bill on the anniversary of the day you signed up.
Fees are recurring, payable in advance, and non-transferable. You can't resell your membership.
Payments are processed by Stripe on behalf of More Than Zero, LLC. We never see or store your full card details.
The current price is shown on the sign-up page before you pay, in the currency stated there. Prices are exclusive of any sales tax or VAT applicable where you live.
By signing up you're authorising us to charge your payment method on each renewal date until you cancel.
If we change the price, we'll email you at least 30 days before it applies to you. The new price starts at your next renewal. If you'd rather not pay it, cancel before that renewal and you won't be charged.
If a charge looks wrong, tell us at yay@getmessyart.com as soon as you spot it, ideally within 60 days. Nothing here takes away any chargeback rights you have with your bank or card provider.
5. Cancelling
You can cancel any time. Go to the Subscriptions area of your account in the Get Messy member area and cancel there. It takes effect immediately, meaning you won't be billed again.
You keep your access until the end of the period you've already paid for. Cancel on day three of a monthly membership and you're still in until day thirty.
To avoid the next charge, cancel before your renewal date.
6. Refunds
We offer a full refund within 14 days of joining, counted from your first join date, for any reason at all.
To claim one:
Cancel your membership in your account, so you don't renew while we sort it out.
Email yay@getmessyart.com and ask for a refund.
We'll refund to your original payment method within 15 business days.
If you're in the UK or the EU, you also have a statutory right to withdraw from a distance contract within 14 days. Our policy above matches it, so you don't need to do anything different. Where your local consumer law gives you more than this policy does, your local law wins.
Where we close an account because someone has seriously breached these terms or the community guidelines, we don't refund the remaining period.
7. Changes to the Service
Get Messy has been running since 2014 and it has changed a lot in that time. It'll keep changing.
We can modify or discontinue any part of the Service. Where a change materially reduces what you're getting, we'll give you at least 30 days' notice by email, and you can cancel and get a pro-rata refund of the period you've paid for and won't now receive.
We'll give you at least 30 days' notice before shutting the Service down entirely, so you can download anything of yours you want to keep. After that we're not obliged to keep hold of your account content, except where the law says we must.
8. Your artwork and what you post
Your artwork stays yours. Full stop. Posting a journal page in the community doesn't make it ours.
What you do give us is permission to show it where it needs to be shown. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute the content you post, for the purpose of running the Service. That licence lasts as long as your content is on the Website, and ends when you delete it or close your account, other than copies sitting in backups or in threads where other members have quoted you.
We will ask you first before using your artwork in marketing, on social media, on the sales page, or anywhere outside the Service. Every time. No exceptions.
When you post something, you're confirming that:
it's yours to post, or you have permission
it isn't illegal, and doesn't infringe anyone's rights
it isn't defamatory, harassing, hateful or obscene
We can edit or remove anything posted to the Website, and we don't pre-screen everything that gets posted. We're not responsible for what other members post.
Membership is also subject to our community guidelines, which form part of these terms.
9. Privacy in the community
Get Messy works because people feel safe being unfinished in public. So there's one rule:
What's shared in the community stays in the community. Don't screenshot, repost, quote or forward another member's artwork, words or personal circumstances outside Get Messy without asking them first. This applies during your membership and after it ends.
That's a real obligation, not a vibe. Breaking it is grounds for us to close your account without a refund, and the member affected may have their own claim against you.
You're responsible for your own interactions with other members. We don't vet or background-check anyone. Any contact you have with another member, online or in person, is at your own risk.
10. Our content
Except where we say otherwise, we own the classes, tutorials, videos, prompts, written material and design on the Website.
You may: view it, download PDF files for your own personal use, print it for yourself, and share a link to it on social media.
You may not:
republish our content anywhere, unless we've expressly said you can
sell, rent or sub-license it
reproduce or duplicate it for commercial purposes
modify it, unless we've expressly said you can
redistribute it, unless we've expressly said you can
Share buttons and widgets on the Website give you a limited licence to republish that specific content on the social channels they point to, with credit to Get Messy. Using them doesn't waive anything else.
You also must not:
do anything that damages the Website or its availability
decompile, reverse engineer or disassemble it, beyond what the law expressly permits
upload or transmit malware, viruses, keyloggers or similar
scrape, data mine, harvest or run automated collection against the Website without our written permission
send unsolicited commercial messages through the Website
use the Website for third-party marketing without our written permission
11. Trademarks
"Get Messy", our logo and our trade dress belong to us. Don't use them in connection with anything that isn't ours, in a way that confuses people, or in a way that disparages More Than Zero, LLC, Get Messy (Pty) Ltd, getmessyart.com or the teachers featured on the Website.
Third-party trademarks that appear on the Website belong to their owners.
12. Copyright and DMCA
We respect copyright and we expect our members to as well.
If you think something on the Website infringes your copyright, send a notice to our designated agent below containing:
A physical or electronic signature of the copyright owner or someone authorised to act for them
Identification of the copyrighted work you say has been infringed
Identification of the material on our Website you say is infringing, with enough detail for us to find it
Your address, telephone number and email address
A statement that you believe in good faith that the use isn't authorised by the copyright owner, its agent or the law
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf

We'll remove or disable access to material that's the subject of a valid notice, usually within 24 to 48 hours, and tell the member who posted it.
Counter-notice. If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same agent with your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your contact details, and your consent to the jurisdiction of the US federal court for your district (or Delaware, if you're outside the US). We may restore the material in 10 to 14 business days unless the original complainant files a court action.
Repeat infringers. We'll close the accounts of members who repeatedly infringe copyright.
13. Third-party sites
The Website links out to places we don't control. We're not responsible for what's on them, and their terms are between you and them. Do your own homework before buying anything from a third party you found through us, and if something goes wrong with that transaction, it's not ours to fix.
14. What we don't promise
We put real care into what we make. What we can't do is promise it'll work perfectly, or that it'll produce a particular result for you.
THE WEBSITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
We don't warrant that the Website will meet your requirements, run uninterrupted, or be free of bugs. Everything's in English and we make no promises about translations.
Tutorials. Some involve tools like craft knives, hot glue guns or bookbinding awls. Follow them at your own risk and be sensible.
Mental health. Get Messy talks about creativity, blocks and the difficult stuff that comes up when you make things. None of it is therapy, and using the Website doesn't create a therapist-patient relationship with anyone here. If something you read hits hard, please talk to a doctor or a mental health professional.
Some places don't allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here excludes liability for death or personal injury caused by our negligence, or for fraud.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA OR LOST USE, HOWEVER CAUSED, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN.
OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS IS CAPPED AT THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places don't allow these limits, so they may not apply to you in full. Nothing here limits liability that the law says we can't limit.
16. Indemnity
You agree to cover us, our members, managers, employees and agents for any third-party claims, and reasonable legal costs, arising from:
your negligence or deliberate misconduct
your breach of these terms
content you posted, including claims that it infringes copyright, trademark, privacy or publicity rights, or is defamatory
death, injury or property damage arising from what you did
17. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The state and federal courts located in Delaware have exclusive jurisdiction, and you consent to that jurisdiction.
If you're a consumer, this doesn't take away your right to bring a claim in the courts of the country you live in, or to rely on the mandatory consumer protection laws of that country. UK and EU consumers keep their statutory rights in full.
Please email us before doing anything formal. Most things get sorted in a couple of messages. Email yay@getmessyart.com describing the problem and what you'd like to happen. We'll come back to you within 10 business days and both of us agree to try to resolve it informally for 30 days before starting any formal proceedings.
Either of us can still bring a claim in small claims court, and either of us can seek an injunction to protect intellectual property, without waiting out the 30 days.
Time limit. Any claim relating to these terms must be brought within one year of the event giving rise to it, or it's waived, except where your local law says otherwise.
EU members can also use the European Commission's Online Dispute Resolution platform.
